New York State’s new SHIELD Act takes effect in March 2020. SHIELD stands for Stop Hacks and Improve Electronic Data Security. The Act requires businesses to implement safeguards to protect private information on all New York State residents. This includes customers and employees.
Anyone with employees in New York must comply with the SHIELD Act because "private information" includes an individual's name and Social Security number. Other private information includes credit and debit cards, financial account information and email addresses.
The SHIELD Act increases civil penalties for data security breaches to $5000 per incident.
